1. Introduction and Acceptance to Agreement

1.1 We appreciate your choice of Shyam's Travel World and strive to ensure that you have a wonderful holiday experience. To avoid any misunderstandings, we kindly request that you carefully read, comprehend, and adhere to the following "Terms and Conditions" and Privacy Policy before booking any tour, holiday, service, or making any transaction with Shyam's Travel World, whether at one of our sales offices or online through our website. By booking any tour or service with Shyam's Travel World, it is understood that you unconditionally consent to accept and abide by these "Terms and Conditions". If you disagree with any part of these "Terms and Conditions", please refrain from proceeding with the booking.

1.2 These "Terms and Conditions" apply to all group tours, customized holidays, corporate tours, and any other services and products such as hotel bookings, flight bookings and train ticket bookings, whether domestic, international, or inbound, organized by Shyam's Travel World.

1.3 Shyam's Travel World has the final authority to interpret these "Terms and Conditions".

1.4 Shyam's Travel World reserves the right to modify, change, add, expand, or waive any stipulation, representation, term, or condition mentioned in these "Terms and Conditions".

1.5 In the event of an unforeseen force majeure situation or any changes in government policy, Shyam's Travel World reserves the right to replace any part of these "Terms and Conditions" with an alternative and valid enforceable provision.

1.6 Each of these "Terms and Conditions" is independent, and if any provision is deemed invalid, illegal, or unenforceable, the remaining provisions shall still be fully effective.

1.7 These "Terms and Conditions", along with any other booking-related terms or communications sent periodically, constitute the entire agreement between Shyam's Travel World and you.

1.8 There is no agreement between the Company and you until the company has received the initial registration amount or deposit, as applicable.

2. Description in brief

2.1 These terms and conditions will be referred to as "Shyam's Travel World Terms and Conditions".

2.2 These terms and conditions may also be called "Rules and Regulations".

2.3 Shyam's Travel World will be referred to as "Shyam's Travel World", "STW", "Shyams Travel World", "the Company", "the organization", "we", "us", or "our". The users of Shyam's Travel World will be referred to as "Guests", "them", "they", "their", "You", "Your", "tourists", "travellers", "clients", "customers", "pax", or "passengers".

2.4 The website of Shyam's Travel World will be collectively referred to as the "Website".

3. Definitions and Terms

3.1 Shyam's Travel World operates under the brand name "Shyam's Travel World" or "Shyams Travel World", and both names will be considered the same and used interchangeably.

3.2 "Website" refers to www.shyamstravelworld.com, and "Web page" refers to a page on the website www.shyamstravelworld.com.

3.3 "Brochure" refers to a document containing tour information in various forms such as printed brochure, e-brochure, e-itinerary, leaflet, booklet, travel planner, tour price list, tour information email, etc.

3.4 "Tour" refers to any domestic, international, or inbound tour organized by Shyam's Travel World.

3.5 "Group Tour" refers to a tour with a minimum of 20 guests for Indian tours and 30 guests for international tours.

3.6 "FIT" stands for Free Independent Travel, and "GIT" stands for Group Inclusive Tour.

3.7 "Corporate Tour" refers to a special tour designed for corporates, industries, institutions, independent organizations, ad-hoc groups, or individuals for meetings, incentives, conferences, exhibitions, seminars, team building, and other events. This segment is also known as MICE (Meeting, Incentive, Conference, Exhibition).

3.8 "Customized Holiday" refers to a tailor-made holiday designed according to the requirements of an individual guest. This segment is also known as FIT.

3.9 "Inbound" or "India Inbound" refers to tours, packages, or any services provided to foreign nationals or non-resident Indians to explore the states of India and the Indian Subcontinent.

3.10 "Speciality Tour" refers to a group tour designed to cater to the special interests of travellers, including but not limited to Honeymoon Special, Women's Special, Seniors' Special, Singles' Special, Short Trips, Cost Saver, Festival Tours, Adventure Tours, Trekking Tours, etc.

3.12 "Travel Advisor" refers to Shyam's Travel World's authorized salesperson who assists and guides guests in booking their Shyam's Travel World tour/service.

3.13 "Associate/Destination Management Company (DMC)/Contractor/Supplier/Vendor" refers to a service provider of a tour or package, including but not limited to airlines, cruises, railways, road transport, hotels, restaurants, caterers, sightseeing attractions, entertainment parks, etc.

3.14 "Tour Manager/TM/Tour Leader/Tour Escort/Tour Assistant/Tour Guide/Yatra Aapki, Sewa Humari" refers to a person designated by Shyam's Travel World to conduct the tour according to the itinerary. They will also assist or guide the guests during the tour.

3.15 "Guests" refers to all the tourists, travellers, vacationers, sightseers, visitors, backpackers, customers, clients who have registered their names or inquired about a tour/package or booked a tour by making partial or full payment for any scheduled tour, customized package, or any other travel-related service provided by Shyam's Travel World.

3.16 "Gender" - The masculine gender includes the feminine gender and vice versa. The singular includes the plural and vice versa, including grammatical variations if any.

3.17 "Tour price" refers to the price mentioned in the Tour Price Grid on the website/SMS/email/Whatsapp/brochure/e-brochure/leaflet/advertisements on print, electronic, and social media, etc. that guests need to pay to book the tour. Taxes and surcharges, if any, are payable in addition to the Tour Price.

3.18 "Child" refers to a guest who is below the age of 11 years.

3.19 "Infant" refers to a guest who is below the age of 2 years.

3.20 "Extra bed" or "mattress" refers to an additional roll-on mattress placed on the floor in a twin/double bed room.

3.21 "Surcharge" refers to an additional fee/charge/tax imposed on the initially quoted tour price due to peak season/special event, charged by associates/suppliers/contractors/tourism or government authorities.

3.22 "Peak Season" and "Super Peak Season" refer to seasons of the year where the demand exceeds the supply, resulting in an overall increase in costs. This includes, but is not limited to, Summer Vacation, Diwali Vacation, Christmas Vacation, New Year Holidays, any Country Specific Vacation/Festival, or National/International Events, etc.

3.23 The "First Day/Last Day/Day" of the tour starts at any time (morning/afternoon/evening/night/midnight) at the first destination based on the arrival of the respective flight/train/cruise or any other mode of transport. The same applies to the last day of the tour. In other words, a "Day" of the tour refers to a part of the day, 24 hours, or any part thereof.

3.24 "Meal Service" on the tour includes pre-set breakfast (B), lunch (L), dinner (D), and/or any other snacks and mineral water bottles as mentioned in the itinerary.

3.25 "Jain Meal" on the tour refers to food without onion, garlic, and potatoes served at lunch and dinner as per the tour itinerary, not necessarily before sunset. It may be a buffet service or a table service.

3.26 "VISA" stands for "Visitor's International Stay Admission" and refers to a conditional authorization granted by the immigration authorities of a territory to foreigners, allowing them to enter, remain within, or leave that territory for a specified period of time. This can be in the form of a paper authorization or a stamp/sticker endorsed on the applicant's passport. Shyam's Travel World acts as a facilitator and does not have any role in the granting/rejecting of the Visa.

3.27 'Force Majeure' refers to an event or circumstance that is beyond the control of Shyam's Travel World and prevents them from fulfilling their obligations or responsibilities regarding the tour. This includes events such as war, terrorism, natural disasters, government orders, and infectious diseases.

3.28 'Cancellation Policy' is a policy outlined in Shyam's Travel World's 'Terms and Conditions' that specifies the applicable charges guests must bear if they cancel their tour.

3.29 'Cancellation Charge' is the charge that guests must pay when they cancel their tour for any reason.

3.30 'Refund' is the repayment of the money paid by the guest at the time of booking the tour, after deducting the applicable cancellation charge.

3.31 'Future Tour Credit Note' (FTCN) is a credit voucher issued by Shyam's Travel World when a tour is cancelled. The guest must use the FTV to book a future tour with Shyam's Travel World within a specified period and according to the agreed terms.

3.32 'Tour Transfer Charges' (TTC) is the estimated maximum charge that guests may have to pay if their booked tour is postponed due to unavoidable or force majeure circumstances.

3.33 'Operational Expense' refers to the expenses that Shyam's Travel World incurs in the normal course of conducting its tours and business operations.

3.34 'Jurisdiction' refers to the geographical area in which a court or government body has the authority to exercise its power. In any legal matter involving the company, the parties agree to confer exclusive jurisdiction to the Ahmedabad Courts/Forums.

4. Booking

4.1 When a guest enquires about or purchases a product offered by Shyam's Travel World through its website or sales channels, they enter into a contract with the company. By booking the product/service, providing their information, and making the payment, the guest indicates their interest in the tour and agrees to the terms and conditions stated on Shyam's Travel World's website/travel planner/brochure/booking form.

4.2 For customized holiday bookings, guests can work with Travel Advisors to create a tailor-made holiday. A non-refundable Holiday Design Fee must be paid at the time of enquiry, which will be adjusted in the booking amount if the holiday is booked within a specified period.

4.3 For corporate tour bookings, the terms of the service contract signed with the corporate/industry/institution/organization/group also apply.

4.4 Guests can register on Shyam's Travel World's website www.shyamstravelworld.com  for tour information and must ensure the confidentiality of their login credentials. The company is not liable for any loss or damage resulting from failure to comply with this.

4.5 Communication from Shyam's Travel World will be made through registered contact details provided by the guests. It is the guest's responsibility to ensure the validity of the contact information and check messages regularly.

4.6 Guests must be physically and mentally fit to travel and take care of their health throughout the tour. The company reserves the right to decline or discontinue the guest's participation if they are found unfit to travel or their medical condition causes inconvenience to others. Any expenses due to health issues are the guest's responsibility.

4.7 Guests must comply with mandatory health requirements for travel, such as vaccinations and COVID-19 tests. Any costs incurred for these requirements are to be borne by the guests.

4.8 Travel during pregnancy is not recommended, as the company does not provide specialized facilities for childbirth or prenatal care. Guests should consider the risks and potential complications that may arise during pregnancy while traveling.

5. Tour Price, Tour Registration, Payment

5.1 Guests must make the payment to Shyam's Travel World using various methods, including digital payments. Cash payment in INR is accepted as per government guidelines.

5.2 Convenience charges may apply for payments made using credit cards, debit cards, and online transfers.

5.3 The tour price is dynamic and subject to availability. Early bookings may receive lower prices, while last-minute bookings may have higher prices. The company does not entertain claims regarding different tour prices within the same group.

5.4 The tour price is calculated based on prevailing tariffs and taxes. The company reserves the right to alter the price in case of changes in taxes, fuel charges, foreign exchange rates, etc., which will be borne by the guest.

5.5 Government taxes, including GST, are not included in the tour price and must be paid separately. TCS is also applicable for international travel packages, with different rates depending on guest requirements. The TCS amount cannot be refunded by the company.

5.6 Guests who book tours online must reconfirm and authenticate the provided information. Misleading information may result in booking cancellation and forfeiture of the amount paid.

5.7 The amount paid at the time of booking is non-refundable and does not accrue interest. The amount varies depending on the tour, with higher amounts required for tours that include air or cruise bookings. Payment of the booking amount only secures registration for the tour and does not include services such as air tickets, visas, and hotel accommodation. Full payment for the tour must be made at least 50 days before the departure date, or immediately at the time of booking if the tour is booked within 50 days of departure. If the booking amount is not paid in full at the time of booking, the remaining balance must be paid within 3 days, otherwise the booking will be cancelled.

5.8 The registration amount for a tour/package is 50% of the total tour price and must be paid within three days of booking.

5.9 If the full tour price is not paid 50 days prior to the departure date, the booking may be cancelled and the advance amount forfeited.

5.10 For customized holidays, full payment for the air ticket and at least 25% payment for the land package must be made to confirm the booking. If payment is not cleared by the specified timeline, the booking may be cancelled without notice.

5.11 If the guest pays for the tour by cheque and the cheque is dishonored, the company may charge a fee and take legal action against the guest.

5.12 The guest should not share confidential information such as credit/debit card details, passwords, etc. with anyone, including employees of Shyam's Travel World. If such information is demanded, the guest should not proceed with the transaction and should immediately inform Shyam's Travel World. The co

5.13 All money paid by the guest to Shyam's Travel World belongs to the company and is used for pre-booking and providing services for the tour. The guest acknowledges that the company does not hold the money on behalf of the guest.

 

6. General Inclusions in Group Tour

6.1 Group tours generally include airfare (if applicable), accommodation, transportation, meals as mentioned in the itinerary, sightseeing, tour manager services, visa fees for Indian nationals (excluding "Gratis Visas"), driver and guide tips. This is not an exhaustive list and other inclusions may be mentioned in the tour itinerary.

 

6.2 General Exclusions in Group Tour (GIT) include visas that are not included in the tour price, personal expenses such as porterage, laundry, telephone charges, shopping, additional food or beverages not included in the pre-set menus, courier charges, transportation to and from the tour's reporting and dropping points, expenses incurred in case of tour discontinuation, additional expenses due to unforeseen circumstances, government taxes, fuel surcharges, sightseeing charges, etc. This is not an exhaustive list and other exclusions may be mentioned in the tour's website, brochure, or itinerary.

 

6.3 Any additional charges for upgrades such as first class, business class, premium economy, seat selection, separate vehicle, or room category change, levied by airlines, cruises, hotels, or transport companies, are not included in the tour price and must be paid by the guest in addition to the tour price.

 

7. Payment Options

7.1 Travel Loan: Guests can avail travel loans from banks and financial institutions on an EMI basis. The terms and conditions of the EMI facility are determined by the respective bank/financial institution/issuer. Shyam's Travel World is not responsible for any disputes related to the EMI facility.

 

7.2 Credit Card EMI: Credit card holders can avail Equated Monthly Instalments (EMI) facility through their bank for tour payments. The terms and conditions of the EMI facility are determined by the bank. Shyam's Travel World is not responsible for any disputes related to the Credit Card EMI facility.

 

8. Discount Policy

8.1 Discounts on tour prices are at the discretion of Shyam's Travel World. The discount policy, including validity, amount, percentage, number of seats, dates, age group, category, full payment, part payment, registration amount, early booking, last minute booking, and group booking, is controlled by the company and may be subject to changes without notice. Any discount offer is valid for a limited period, limited tours, and subject to availability.

 

8.2 If the guest does not fulfil the conditions of the discount, such as making full payment within the specified timeline or submitting required details/documents on time, the discount facility will be withdrawn and the tour will be re-priced accordingly.

 

8.3 The provision of any complimentary service/item is at the discretion of the company and may be revoked, amended, or discontinued without notice. Shyam's Travel World is not responsible for any defects or damages related to complimentary snacks provided on tour.

 

8.4 Early bookings may come with benefits, such as a "free experience" on the tour. This benefit is available for selected tours and guests who book within the promotional timeline. If the guest is not eligible for the free experience, they may purchase it at an additional cost, subject to availability. The provision of free experiences is at the discretion of the company and may be revoked or amended if the guest count falls below a prescribed number.

 

8.5 Any discount or benefit offered in advertising campaigns is supported by the marketing budget of Shyam's Travel World and cannot be encashed or refunded.

 

10. Documentations

10.1 To book a tour, guests must have a valid photo ID proof for domestic tours and a valid passport for international tours. PAN submission is mandatory for both domestic and international tours. Guests are responsible for holding valid travel documents such as passports, visas, confirmed air tickets, insurance, and any required medical or legal certificates. Failure to possess the necessary documents may result in tour cancellation and applicable cancellation charges.

 

10.2 For domestic tours in India, guests must carry photo identification such as Aadhar card, Voter ID card, PAN card, driving license, or school/college ID card.

 

10.3 For international travel, all guests, including children and infants, must have a machine-readable passport valid for at least 180 days from the tour return date, along with the applicable visas. Guests should ensure the accuracy and validity of their passports and that they meet the requirements of the tour. Shyam's Travel World may collect and submit passports to authorities on behalf of guests for certain tours, but is not responsible for any loss or damage to the passport during this process.

 

10.4 Visa (International Tours):

  1. A visa is a necessary authorization issued by the consulate that allows guests to enter a country for a limited period of time. Guests must ensure they have valid visas to join the tour. Shyam's Travel World assists guests in preparing visa documents, submitting them, and collecting passports from the consulate on their behalf. Some consulates send passports directly to the guest's residence.
  2. During the visa process, the consulate may contact guests for more information or request a personal interview, even if all relevant documents have been submitted. Guests must provide correct address and contact details on the visa application form. The decision to issue a visa is at the discretion of the consulate, and Shyam's Travel World cannot object to or take any legal action against visa rejections.
  3. Once guests receive their passports from the consulate, they must check the visa copy for any errors or discrepancies in name, gender, passport number, type of entry, validity, date of entry/exit, and duration of stay. Any discrepancies should be immediately reported to Shyam's Travel World's Travel Advisor. The company will try to get it corrected from the consulate, but cannot guarantee timely action and will not be responsible for any consequences.
  4. For Schengen visa of Europe tours, full payment of the tour price must be made before processing the visa application. If only a part payment is made, guests must maintain sufficient bank balance equivalent to the total tour price for at least six months in their bank account.
  5. For certain countries, if a valid visa is on the old passport, guests must carry both the old and new passports on the tour. In some cases, guests are required to transfer the valid visa from the old passport to the new one at the respective consulate and bear any associated costs. Guests should stay updated on the rules of the respective country/consulate/embassy.
  6. If guests already possess a valid visa for the duration of the tour or wish to process the visa(s) on their own, they should inform Shyam's Travel World's Travel Advisor at the time of booking. In such cases, guests will be entitled to a reduction in visa fees.
  7. It is the guest's responsibility to submit all required visa application documents well in advance to Shyam's Travel World. However, some consulates have restrictions on how early a visa can be applied/processed before the tour departure date. Visa processing time may be longer than expected due to high demand at consulates or embassies. Even if documents are submitted well in advance, visas may be delayed and not received before the tour departure. In such cases, if guests cannot join the tour, cancellation charges will apply.
  8. Guests serving in high-security institutions/corporations like Bhabha Atomic Research Centre (BARC), defense/armed forces, or chemical/nuclear industries should book their tour early and apply for the visa well in advance, as it may take longer than usual visa processing time. The visa requirements for these guests are different from regular guests. Shyam's Travel World will not be responsible for any consequences or liable for any refund if their visa is delayed or not granted.
  9. If guests have any dispute with the consulate/embassy and decide to legally challenge the authority, Shyam's Travel World will not be involved and unable to represent anything in that matter.
  10. Any increase in visa fees/VFS charges/service charges between the tour launch and visa application date must be borne by the guest.
  11. In some cases, an additional visa may need to be applied for, in addition to the visa(s) already included in the tour price. In such cases, guests will have to bear the additional visa cost.

 

10.5 Travel Insurance:

  1. All guests traveling within India or overseas must have travel insurance. For international tours, overseas travel insurance is included in the tour price for guests below 59 years of age. Guests above 59 years of age will have to pay the difference in insurance premium. This insurance provides limited coverage for loss of baggage, flight delays/cancellations, hospitalization, death, repatriation, evacuation, etc. Some adventure activities included in the tour itinerary may or may not be covered by the insurance policy.
  2. The insurance copy is sent to guests via email before the tour departure. Guests should verify their personal details on the insurance copy and be aware of the coverage under the policy. It is mandatory for guests to carry their insurance copy on the tour and present it when asked. Overseas travel insurance does not cover pre-existing diseases. Guests who want higher coverage can upgrade their travel insurance by paying an additional premium.
  3. Guests taking pre or post tour extensions should extend their existing insurance policy by paying the required additional premium. Non-Resident Indians (NRIs) or foreign nationals must obtain insurance on their own before joining the tour.
  4. In the event of an incident leading to an insurance claim, guests must inform the Insurance Company and Shyam's Travel World within 24 hours.
  5. The overseas travel insurance policy is at the discretion of the respective insurance company. Shyam's Travel World is a facilitator and has no control over their operations or the claim process. Guests must directly communicate with the insurance company and provide the necessary documents for claim settlement. The decision to grant or reject the claim is solely up to the insurance company, and Shyam's Travel World is not responsible. Any disputes regarding settlement amount or claim rejection should be dealt with directly by the guests with the insurance company.
  6. Guests traveling to international destinations under Customized Holidays or Corporate Tours (MICE) must purchase their travel insurance separately through Shyam's Travel World or other resources.
  7. Foreign nationals or NRIs arriving in India on an Inbound Tour or any Group Tour must purchase their travel insurance separately on their own before starting the journey.

 

10.6 Foreign Nationals or Non-Resident Indians (NRIs):

  1. Foreign nationals and Non-Resident Indians (NRIs) who wish to join Shyam's Travel World's India or Indian subcontinent tours must have a valid visa for the required number of days and must comply with all laws, rules, and regulations of the Government of India/respective country during the tour. They must declare their nationality/NRI status before booking the tour. Tax regulations may differ for these guests, and they should contact the Travel Advisor for more details.
  2. These guests must carry all relevant documents, including passport, visa, insurance copy, OCI/PIO card (if applicable), etc., with them on the tour. Incomplete or missing documents may result in denial of entry, and guests will have to discontinue the tour at their own expense. Shyam's Travel World is not responsible for any consequences or expenses in such cases. Certain destinations or sightseeing places may have restrictions or extra fees for foreign nationals or NRIs, according to entry regulations.
  3. Foreign nationals and NRIs who wish to join any other Indian or international tour of Shyam's Travel World must have a visa for all countries included in the tour and valid for the required number of days according to the tour itinerary. They must comply with all laws, rules, and regulations of the respective countries during the tour.

 

10.7 Minors:

  1. Child safety and protection are of utmost importance. To prevent child abduction, most countries have strict regulations that require specific documents for visa applications or when traveling. Children under 18 years of age must be accompanied by a parent or adult responsible for their welfare and supervision, or they must have a written consent letter from the parent(s) to join the tour. It is the guest's responsibility to take care of their accompanied minors throughout the tour and be aware of their whereabouts.
  2. Minors under the age of 18 traveling with one parent must have a notarized letter of consent from the non-traveling parent. If one parent is deceased or the child has only one legal parent, a notarized statement must be obtained and carried as proof on the tour. Some countries may issue a minor visa linked to the visa of an adult traveling with the minor, while others may require a no-objection certificate (NOC) from both parents for visa application.
  3. Failure to submit the appropriate documentation may result in tour cancellation, and the company is not responsible for any consequences or losses.

 

10.8 Immigration:

  1. Having a valid visa only allows guests to enter the immigration point of the respective country. Granting or rejecting permission to enter that country is solely at the discretion of the immigration authority.
  2. Sometimes guests may be interrogated, held back, or deported by the immigration authority. In such cases, guests may miss out on parts of the itinerary or have to join or discontinue the tour midway. All expenses incurred in these situations will be borne by the guests, and Shyam's Travel World is not responsible. Guests will not be eligible for any refunds or compensations from Shyam's Travel World.

 

  1. Tour Itinerary

 

11.1 Shyam's Travel World strives to follow the original tour itinerary as closely as possible. However, the itinerary provided at the time of booking or on the website/brochure/leaflet is subject to change due to various factors such as regulations, transportation issues, and weather conditions.

 

11.2 Shyam's Travel World reserves the right to modify the itinerary before or during the tour. Guests will be informed of any changes through email, SMS, or by the Tour Manager.

 

11.3 Changes to the itinerary may be necessary due to unforeseen events such as festivals, weather conditions, or closures of attractions. Additional charges may apply in such cases.

 

11.4 Shyam's Travel World may add, delete, or exchange sightseeing attractions or services to improve the itinerary. If any additional attractions or services require extra charges, guests will be responsible for paying them.

 

11.5 If certain sightseeing attractions or destinations cannot be visited on the planned dates, Shyam's Travel World will try to arrange an alternate visit. If that is not possible, an alternative sightseeing option or a refund of the entry fee may be provided.

 

11.6 If a sightseeing place or adventure activity cannot be done for any reason, an alternate option may be arranged if possible. If an alternate cannot be arranged and a refund is not applicable, no compensation will be provided.

 

11.7 Itinerary changes may occur in the event of any mishap during the tour.

 

11.8 Tours or packages that include helicopter, seaplane, cruise, or ferry services are subject to availability, weather conditions, and other requirements. Shyam's Travel World is not responsible for any operational issues and may use alternative services if necessary. The company will not be liable for any damages or losses incurred by guests.

 

11.9 Shyam’s Travel World is not liable to pay any compensation or damages for changes in the itinerary beyond their control.

 

12. Joining and Leaving Guest (J&L)

 

12.1 Joining and Leaving (J&L) or Ex destination guests are travellers who book Shyam's Travel World group tours without availing visa, insurance, and main sector air tickets to reach the first destination of the tour and leave from the last place of sightseeing/restaurant/hotel/airport to return home. These guests must make the J&L or Ex destination tour payment in the designated currency at Shyam's Travel World sales offices or through electronic transfer.

 

12.2 J&L or Ex destination guests must have valid air tickets, passports, visas, and insurance for the tour. They are responsible for arranging their own airport transfers, if required.

 

12.3 Guests should confirm the tour details with their Travel Advisor and make flight bookings accordingly. Refundable air tickets are recommended in case of any changes to the tour date. If non-refundable tickets are purchased and the tour date changes, guests will have to purchase new tickets at their own cost. Shyam's Travel World is not liable for any loss or cancellation due to this.

 

12.4 Guests must share copies of their air tickets, visas, and insurance with their Travel Advisor before the tour. They should also provide their local contact details and be aware of the reporting place, Tour Manager's name, and local contact number.

 

12.5 Additional services such as pre/post accommodation, transfers, sightseeing, and meals will incur extra charges, which must be settled immediately or 50 days prior to the tour departure.

 

12.6 Due to unforeseen circumstances or changes in airline schedules, sightseeing schedules on the first or last day of the tour may be altered. In such cases, J&L or Ex destination guests may miss out on sightseeing or on-tour services. Shyam's Travel World will not provide refunds or compensation for missed activities.

 

12.7 J&L or Ex destination guests must reach the scheduled reporting place at their own cost as advised by the Travel Advisor or Tour Manager. If a guest is unable to join the tour at the pre-decided reporting place, the group will proceed as per the itinerary, and the guest will have to join them wherever possible and bear the expenses.

 

13. Deviation Guest

13.1 Deviation guests are travellers who book Shyam's Travel World group tours but choose to deviate from the scheduled itinerary for personal reasons.

 

13.2 Guests who wish to travel in advance or return at a later date must inform the Travel Advisor at the time of booking. The Travel Advisor will guide them on the necessary changes to be made, such as airline date changes, visa extensions, additional services, and insurance validity. Additional charges will apply for these changes and must be paid by the guest immediately.

 

13.3 Deviation requests are subject to availability. If the requested change is not available, guests will have to choose from alternate options.

 

13.4 Guests are responsible for reconfirming their air tickets and flight schedules 24 hours before departure.

 

13.5 If guests choose to deviate from the tour itinerary on their own, they must join or leave the tour at their own cost as advised by the Travel Advisor or Tour Manager. If a guest is unable to join the tour at the pre-decided reporting place, the group will proceed as per the itinerary, and the guest will have to join them wherever possible and bear the transportation expenses.

 

13.6 Deviation guests must check their air tickets, visas, and insurance for travel dates and validity before the tour. Shyam's Travel World can assist with deviations but does not guarantee them and will not be held responsible for any consequences.

 

14. Post Tour Holiday

 

14.1 Shyam's Travel World offers the option of a Post Tour Holiday package, allowing guests to extend their holiday after the scheduled group tour in the same city, country, or a destination of their choice.

 

14.2 Guests who opt for a Post Tour Holiday must inform the Travel Advisor at the time of booking. The Travel Advisor will guide them on the necessary changes to be made, such as airline return ticket date changes, visa extensions, and insurance validity. Guests can choose from readymade Post Tour Holiday packages or request a customized holiday. The additional charges for the Post Tour Holiday must be paid by the guest immediately.

 

14.3 Post Tour Holiday requests are subject to availability. If the requested package is not available, guests will have to choose from alternate options.

 

14.4 Guests are responsible for reconfirming their return air tickets and flight schedules 24 hours before departure.

 

14.5 Post Tour Holiday is not an escorted group tour but a customized holiday. All inclusions and exclusions will be as per the itinerary.

15. Airline

15.1 Shyam's Travel World offers group tours that may or may not include flights, depending on the itinerary. For group tours that include flights, seats are reserved well in advance by Shyam's Travel World, sometimes even a year before the tour departure date, by paying a deposit to the airline. The actual ticketing for the group is done prior to departure according to the airline's policy. Any increase in airfare, taxes, fuel surcharges, airport development fees, etc. between the tour launch date and departure date will be the responsibility of the guests and must be paid before the tour departure.

When guests book an air-inclusive tour or an air ticket with Shyam's Travel World, it is understood that they have accepted the airline's terms and conditions regarding travel, baggage, meals, services, etc., as well as the applicable national and international laws governing air transportation such as DGCA, IATA, PATA, etc. If there is a discontinuation of airline service or a change in airline route, flight schedule, flight delays, etc., any additional expenses incurred to continue the tour will be the responsibility of the guests.

Guests must be careful when filling out and verifying their booking form, ensuring that details such as name spelling, age, birth date, contact details, passport number, date and place of passport issue, etc. are correct. The name on the booking must always match the passport for international tours and the Aadhar card for domestic tours. Incorrect details may result in name correction (if time permits), denial of boarding, deportation, cancellation of the tour, etc. Guests will be responsible for any consequences, losses, or additional expenses arising from incorrect details, and Shyam's Travel World will not be held responsible or liable.

If guests book an individual air ticket with Shyam's Travel World, they must ensure that they do not hold any other air ticket with the same or a different airline for the same date, as this may result in the automatic cancellation of the air ticket and the guest will be responsible for any consequences arising from this.

 

15.2 Baggage:

Shyam's Travel World provides information about baggage allowance to guests before the tour departure. Guests should also check and comply with the baggage allowance and conditions of the airline(s) they are traveling with. Any excess baggage charges must be borne by the guests.

Guests are advised to travel light, pack their own belongings, and use stroller bags as they will have to carry them on their own.

 

15.3 In-flight Seating:

Economy class air tickets are reserved for guests of air-inclusive tours with Shyam's Travel World, and specific seating such as front row, emergency row, aisle seat, window seat, etc. are not included. If guests wish to book a specific seat, they must inform their Travel Advisor and make the necessary payment. This request is subject to availability with the airline.

On the day of departure, guests can upgrade from economy to premium economy, business, or first class, subject to availability, by paying the additional amount to the airline.

 

15.5 In-flight Meals:

In-flight meal service is at the discretion of the airline.

Requests for vegetarian/non-vegetarian meals and/or special meals must be made at the time of booking and are subject to availability with the airline.

Shyam's Travel World is not responsible for any unavailability of requested meal types/quantities or the quality of in-flight meals.

On domestic and short-haul international tours, in-flight meals are not included in the air ticket, and guests are advised to carry snacks for the flight journey.

 

15.6 Airport Service:

Various airports offer special services such as lounge facilities, attendants, Pranaam Guest Services, etc. at an additional cost. Guests who wish to avail of such facilities may inform their Travel Advisor to pre-book them. Wheelchair facilities for seniors or physically challenged guests are also available at the airport if pre-booked and are mostly free of cost. These facilities are subject to availability.

 

16. Baggage and Belongings

16.1 Guests are advised to travel light, not carry any valuables on the tour, and take utmost care of their baggage and belongings at all times. Guests should not leave their belongings such as mobile phones, cameras, laptops, jewellery, gadgets, passports, visas, tickets, currency, purses, bags, etc. unattended. It is recommended to use digital payment systems like forex cards, credit cards, mobile payments, e-wallets, etc. during the tour. Guests are solely responsible for their personal baggage and belongings, and Shyam's Travel World or its representatives are not responsible for any loss, theft, damage, or accidents involving such personal belongings during the tour, flight journey, coach travel, hotel stay, or sightseeing places, regardless of the reason.

 

16.2 In case of any loss, theft, damage, or accident, it is the guest's sole responsibility to file a complaint with the relevant local authorities such as the police, private bodies, airline office, etc. and follow up on the matter.

 

16.3 Any claims regarding loss, theft, damage, accident, or negligence involving any associate such as the airline, hotel, coach company, sightseeing places, etc. should be directly addressed with the respective associate or insurance company (if applicable). Shyam's Travel World is not liable to compensate the guest for any disputes regarding the adequacy of settlement amounts or rejection of claims by the associate or insurance company.

 

16.4 Customs, immigration, and airlines have restrictions on the carriage of certain items/articles/objects during travel. There is also a restriction on the amount of currency a traveler is allowed to carry. All guests should be aware of these restrictions and ensure compliance. If guests are carrying any restricted objects, excess money, or misplace their passports, they may be detained or miss a flight, and the tour may have to be curtailed. Shyam's Travel World will not be responsible for any losses or additional expenses arising from such situations.

 

17. Road Travel on Tour

17.1 For tours, air-conditioned/air-cooled/non-air-conditioned vehicles are used based on the itinerary. The mode of transport for road journeys includes big coaches, mini coaches, tempo travellers, jeeps, cars, or taxis depending on the type of tour, itinerary, road conditions, and the number of guests in the tour.

 

17.2 Seat allotment in the coach is based on the booking date priority of the tour. This also applies when two or more tours are merged together. Seat numbers are assigned one day before the tour departure and given to guests on the first day of the tour by the Tour Manager. Seat numbers cannot be provided at the time of booking or before the tour departure.

 

17.3 In coaches, seat allotment starts from seat number 5 onwards, as seat numbers 1 and 2 are reserved for the Tour Manager, and seat numbers 3 and 4 are reserved as prime seats, which can be booked by guests at an additional cost if available. If paid prime seats are not available for any reason, the company will refund only the prime seat cost to the guest. Prime seats do not apply to smaller vehicles.

 

17.4 For certain tours, small vehicles (Etios/Dzire/Innova or similar) are used for road travel. One car can accommodate 4-6 guests. The Tour Manager will share one of the cars in the group on a rotational basis. These cars are meant for road journeys and sightseeing according to the tour itinerary and are not at the disposal of individual guests or groups.

 

17.5 Guests or groups of guests can opt for a separate vehicle for their family, upgrade the vehicle type, or request a tempo traveler/mini coach/big coach for their family/group at an additional cost, subject to availability.

 

17.6 For tours to Leh Ladakh, Andaman, Sikkim Darjeeling, and North East, small vehicles will be used with 5-6 guests in one vehicle. Due to the difficult terrain and limited availability of vehicles, the type of vehicles used for these tours may vary on a day-to-day basis. It is not possible to upgrade the vehicle type at these destinations.

 

17.7 The coach captain/vehicle driver plays a vital role in the successful operation of the tour. Guests are requested to treat them with respect and be aware of driving rules such as maximum daily and weekly driving hours and their rest periods.

 

17.8 Guests have a duty to be punctual, follow the day's schedule, and complete the sightseeing/program as per the itinerary. If a guest does not report to the coach at the designated time, the coach will proceed to the next point/destination in the program, and the guest will have to join the group at the next point/destination at their own expense.

 

17.9 To maintain the comfort and safety of the group, there is a strict policy of no smoking, no alcohol, and no eating in the vehicle. Guests are requested to adhere to this policy.

 

17.10 To maintain cleanliness and hygiene, "pay and use" toilet facilities are available at most places, and guests are advised to carry coins/small change for this purpose.

17.11 There is a possibility of a vehicle or its air conditioner failing during the tour. In such cases, the company will try to find a solution as soon as possible. Shyam's Travel World is not responsible for mechanical failures and is not liable for any compensation.

 

17.12 While on tour, it is essential to keep the coach clean. If a guest accidentally or otherwise damages

 

18. Cruises and Rails:

 Shyam's Travel World offers exclusive cruise tours and some tours that include single or multi-night cruises. The prices for cruise inclusive tours are based on the type of cabin mentioned in the itinerary. Guests have the option to upgrade to a balcony cabin or suite at an additional cost, depending on availability. Additional shore excursions and optional facilities on the cruise can be availed by paying an extra charge to the cruise company. It is the responsibility of the guest to be on time for the cruise, as the cruise cannot wait for anyone. If a guest misses the cruise, they will have to make their own arrangements and bear the expenses to catch up with the cruise at the next port of call or destination. Guests traveling on customized holiday packages should be aware of the tipping policy of the cruise and pay accordingly. Some tours also include rail journeys, with air-conditioned chair car or sleeper berths reserved for day or night journeys respectively. Upgrades in rail class are possible at an additional cost, subject to availability. Guests must be on time and not miss the train, as they will have to bear the cost and consequences if they do. The terms and conditions of the cruise or rail companies, as well as Shyam's Travel World's terms and conditions, apply to these services.

 

19. Cancellation and Refund policy:

19.1 Shyam's Travel World has a cancellation and refund policy for its tours and packages. If services are cancelled for a particular departure, the cancellation charges will depend on the time of cancellation. The cancellation policy of third-party services like airlines, cruises, hotels, etc. will also apply in addition to Shyam's Travel World's policy. Guests must submit a written cancellation request via email, stating the reason for cancellation. Once a booking is cancelled, it cannot be reinstated, and any re-booking will be treated as a fresh booking with possible additional charges. Guests agree to the cancellation policy and terms.

 

19.2 The cancellation policy applies in various scenarios. If a guest cancels the tour due to personal reasons, the date of the cancellation request will determine the applicable cancellation charges. If Shyam's Travel World is compelled to postpone or reschedule the tour due to force majeure or uncontrollable factors, no refund will be applicable, and guests will have to choose a future tour date. If a guest cancels the tour due to non-acceptance of changes in the itinerary or services, cancellation charges will apply. Visa rejection or delay will lead to deemed cancellation, and cancellation charges will be based on the date of rejection. If a guest fails to make the partial or full tour payment, the booking will be cancelled, and cancellation charges will apply. If a guest fails to join the tour on day one, it will be treated as a "No Show" and no refund will be applicable. If a guest discontinues the tour, no refund will be applicable. Single guests sharing a room with others may be eligible for a refund of the single occupancy charge if they find a room partner. Shyam's Travel World is not liable to provide details or bifurcation of the tour price or cancellation charges. Any refund payable will be paid within 30 working days of receiving the cancellation request.

 

19.3 Shyam's Travel World reserves the right to cancel a group tour or package due to operational reasons or inadequate participation. In such cases, the amount paid by the guest will be refunded within 30 working days. Shyam's Travel World is not liable to pay any interest on the tour amount and is not responsible for any additional expenses made by the guest.

 

19.4 Shyam's Travel World reserves the right to deny or cancel a booking without providing a reason. They also reserve the right to terminate the tour of any guest who does not follow tour decorum or misbehaves. In such cases, the guest will have to make their own arrangements for return.

 

19.5 If guests wish to transfer their original tour to a new tour, it will be treated as a cancellation of the original tour, and cancellation charges will apply. If guests wish to transfer the tour, they must communicate in writing.

 

20. Accommodation during the tour

 

20.1 General:

Accommodations provided on tours vary depending on the tour/package category. These include resorts, hotels, houseboats, tents, camps, dormitories, hostels, cruises, trains, buses, etc. Accommodation locations usually vary depending on the tour program.

The proposed hotel/accommodation types listed in the travel program are always subject to availability. Similar tours may be offered in different types of hotels/accommodations depending on the capacity and availability of the destination.

Hotel Membership Rewards/Points cannot be earned or redeemed at hotels booked by the Company. 20.2 Room type/category:

 

20.2 Rooms typically have 2 single beds, 1 double bed, or 1 single bed. If necessary, an extra bed in the form of a mattress will be placed on the floor. Depending on availability, you can upgrade your room to a suite, family room or special view room for an additional fee. If guests request additional rooms during the tour, they can do so for an additional fee, subject to availability.

Single rooms are relatively small and may be located on separate floors or in a corner of the hotel.

Allocation of rooms to individuals or groups is at the discretion of the hotel/partner/vendor providing the relevant service and is not controlled by Shyam's Travel World.

 

20.3 Check-in and check-out times:

 At hotels in India and around the world, travellers are typically given a check-in time of 3 pm and a check-out time of 10 am. Our travel programs and itineraries will be planned accordingly. Please note that you will not be able to check into the hotel even if you arrive at your destination early in the morning. In this case, he will be happy to arrange one or more viewings before check-in.

 Individuals wishing to check in earlier or check out later may do so by requesting and paying an additional fee, subject to availability.

Certain types of accommodations may require a credit card/deposit upon check-in. This deposit will be refunded at check-out only if the service is used.

20.4 Room division:

 

  1. Individual guests (solo travellers) who share a room with other guests must follow Shyam's Travel World's room sharing policy. This policy will be sent to the guest's registered email ID at the time of tour booking. Issues such as misunderstandings between roommates, damage/loss of personal items and hotel property. is the sole responsibility of the sharing partners and should be made clear between them. Shyam's Travel World is not responsible for this.
  2. If your room sharing partner behaves in a harmful, unhygienic or intolerable manner, they will be forced to move you to another room immediately during the tour by paying an additional fee for a single room.
  3. 20.5 Children in their parents' room:

 

  1. For convenience and comfort during the tour, we recommend choosing a double room with an additional mattress for a family of three, and two rooms for a family of four. Be it international tours or Indian tours, most hotels do not allow four people to stay in a room for safety reasons.

 

20.5 Property Damage:

  1. Any damage caused to the hotel room/accommodation type during your stay will be your responsibility and must be settled immediately or prior to check-out. If you notice any pre-existing damage in your room, please report it immediately to hotel staff and/or Shyam’s Travel World's tour manager. Shyam's Travel World is not responsible in any way for such losses and will not be liable to pay any charges.
  2. 20.7 Accommodation options:Accommodation including parking, restaurant, cafe, bar, gym, spa, salon, swimming pool, sports and entertainment activities, childcare/play center, conference room, business center, travel agency, doctor on duty, elevator, porter, laundry etc. Facility options, such as internet, Wi-Fi, telephone, minibar, alcoholic beverages, pay TV channels, air conditioning, safe, in-room amenities, and room service may be available depending on tour and destination type and vary by accommodation. . All of these facilities may be free to use, so be sure to check before using. Guests are responsible for paying the charges for using this facility directly to the hotel.
  3. Shyam's Travel World is not responsible for any defects in service, including interruptions in the services, facilities and amenities provided at the hotel or  type of accommodation, and unprofessional conduct of hotel staff, as these are outside the scope of its direct authority. shall not be liable to you. Shyam’s Travel World.
  4. To combat global warming, protect natural resources, and practice sustainability, many countries/governments/communities/private institutions/independent organizations have implemented restrictions on the use of water, electricity, and air conditioning. Each guest is considered to be more responsible. Tourists should follow.

20.6 Tropical/Forest/Outdoor Accommodation:

In many types of accommodation in natural environments, especially tents, camps, safari lodges, and beach resorts, insects such as ants and cockroaches, birds, monkeys, small animals, and occasionally rodents can be observed indoors.  Going outside your room or hotel premises is almost unavoidable. It should never be taken as a sign of dirt as it is just a fact of life in these destinations/locations.

 

21. Meal

21.1 Meals on the tour will be provided as B (Breakfast), L (Lunch) and D (Dinner) as stated in the itinerary/tour program. These are pre-prepared menus that include mostly Indian dishes, and sometimes local and international dishes, depending on the destination and tour.  Indian menus typically include dal, rice, roti, two vegetables, a non-vegetarian dish, salad, side dish, and dessert, but are subject to availability.

 

21.2 Depending on the tour program, pre-packaged meals may be provided at some locations on the tour. 

 

21.3 For group tours, special dietary/meal requests can only be accommodated to a limited extent  if this is advised at the time of booking. Certain locations cannot accommodate special requests, so such guests must bring their own dry snacks.

 

21.4 If informed at the time of booking, Jain/Swaminarayan/onion and garlic free meals will be provided for lunch and dinner as per the  itinerary, but not necessarily before sunset. It will be  buffet service or table service.

 

21.5 A baby's diet usually includes milk, plain dal, and rice. If you are traveling with young children, we recommend that you bring regular baby food with you if necessary.

 

21.6 No substitutions or compensation will be made if a meal is missed  due to a guest's personal reasons.

 

21.7 While we strive to select  quality restaurants for our meals, we  have no direct control over the operations of our restaurants in terms of food, hygiene, hygiene, etc., and Shyam’s Travel World is not responsible for any defects in  quality or service. We are not responsible for. Complaints/claims regarding this are excluded.

22. Tour guide

22.1 Shyam’s Travel World Tour Managers are very popular among  tourists for both Indian tours and international tours. These tour managers will accompany the  group tour from the first day to the last day of the tour as indicated in the itinerary. In order to enjoy your tour to the fullest, please follow the tour manager's instructions regarding the  tour schedule, safety precautions, clothing, things to bring, meals, tourist information, local etiquette, rules of conduct, etc. The Tour Manager is not responsible for  instructions ignored or overridden by the Guest and their consequences. 

 

22.2 Guests are asked to treat tour managers with respect as they will do their  best to ensure a successful tour. In the event of a service issue or complaint during a tour, guests must immediately report it to the tour guide so that a solution can be found and the issue  resolved.

 

22.3 Tour Guides will care for Guests during the  tour, but are not responsible for theft, loss or damage to Guests' belongings or for any injuries or accidents to Guests. Tour conductors must manage the entire group and run the travel program according to the itinerary, so they cannot personally accompany guests or stay overnight in case of an emergency. However, we will assist guests with further processing or filing complaints with local authorities. Any costs incurred will be  the responsibility of the guest.

 

22.4 If a Guest's belongings are lost and found after departure from their destination, the Guest must arrange for and pay the costs of return by courier. Shyam's Travel World or its travel managers are not responsible for recovering lost and found items from the destination.

 

22.5 For smooth operations, clear instructions and verbal communication, the tour manager of Shyam’s Travel World will create his WhatsApp group for the guests on the second day of the tour (in rare cases this may not be possible due to unavailability of the internet). This group is created for the sole purpose of exchanging travel-related instructions and next-day tour programs. If any guests object to being part of this WhatsApp group, they must inform the tour guide immediately so that necessary measures can be taken.

 

22.6 For group tours, the languages of communication are Hindi and English. Tour guides can speak Hindi or English. On overseas tours, local tour guides, local hosts, ship crew, hotel personnel, etc. all speak English. Guests are expected to be familiar with these two languages. If the guest is not familiar with these two languages, the tour manager will do his or her best to make the guest comfortable and understand the tour program.

 

22.7 Shyam's Travel World's Travel Manager is not responsible for, and will not provide any assistance with, any changes or additions to:

  1. The itinerary and its contents under normal conditions are determined in advance by Shyam's Travel World.
  2. Seat allocation is at the discretion of the airline.
  3. Bus Seat Allocation. This will be assigned based on reservation date priority.
  4. Room blocking is at the hotel's discretion. e. If the guest's schedule is not met, they may miss the viewing.

 

23. Shopping

23.1 Shopping is an important travel activity  and an experience in itself. Guests should shop responsibly and consider the price and quality of the items they wish to purchase. All guests are hereby advised that Shyam's Travel World does not endorse or promote any particular store or vendor and is not responsible for items purchased on the tour. Attractions may  have their own souvenir shops, flagship stores, and galleries, and while there may be no obligation to shop, guests can do so if they wish. When shopping, check quality, quantity, price, and pay attention to VAT refunds, baggage allowances, courier charges, shipping charges, freight charges, and customs duties, if applicable.

 

24. Gift certificate

24.1 Shyam’s Travel World offers gift certificates that guests can purchase or gift to loved ones on special occasions.

 

24.2 Shyam’s Travel World may also issue gift certificates to Guests as prizes or benefits.

 

24.3 These gift certificates include:

  1. Gift vouchers can only be redeemed for group tours (subject to availability) or Shyam’s Travel World vacation packages.
  2. There is an expiration date, so please use it within the expiration date.
  3. Cannot be split. Additionally, you may not combine two or more gift certificates for a single tour.
  4. Not transferable, refundable, or redeemable.
  5. Upon redemption, the  guest must provide the digital code  received at the time the voucher was issued.
  6. Gift vouchers cannot be used for day tours/picnics/personal services and  tours with a value below INR 20,000/-.
  7. Shyam's Travel World Terms and Conditions  also apply.

 

 

25. Guest participation in the tour

 

25.1 Shyam’s Travel World welcomes all Indians, NRIs and foreigners to travel within India or around the world. Guests must be in good mental and physical health and should consult a doctor before participating in the tour. If you have a disability, please check the facilities available at your destination before booking your tour and bring your family with you.

 

25.2 The safety and health of all our group travellers is our top priority. Customers who are judged to be unsuitable for participating in sightseeing or continuing the tour due to the risk of endangering their companions will be refused participation in the tour  or  the tour will be canceled. In such cases, Shyam’s Travel World will assist the Guest in making further arrangements, but all costs will be borne by the Guest and no refunds will be given for the trip.

 

 

 25.3 If Guest requires medical assistance during the tour, this will be arranged by a local doctor or hospital. You are responsible for all costs associated with this medical assistance. We recommend that you purchase health insurance that covers hospitalization and other medical expenses.

 

25.4 Because some tours involve rough terrain and/or extensive footpaths (which in some cases may involve cobblestone streets, uneven footpaths, steps, uphill climbs, and/or areas that are not  easily accessible) , you must exercise due caution and caution.

26. Guest Responsibilities

 

26.1 The guest information provided on the booking form is extremely important as all subsequent travel arrangements will be made. Errors can result in significant losses to guests. We therefore ask you to check and reconfirm the details entered in the booking form. If a guest books a tour/package through a Shyam’s Travel World office or agency, they must authenticate their booking form and ensure  they receive a confirmation call and automatically generated SMS from Shyam’s Travel's corporate office. The world received it immediately after  booking.

 

26.2 Accuracy and Reliability of Information Provided by Guest:

 

  1. When a guest provides information to Shyam’s Travel World at the time of inquiry, registration, reservation or during visa and insurance processing, travel dates, name, age, date of birth, address, Aadhar/PAN as required by the visa consulate; /Passport and financial details are accurate, true, current and complete in all respects.
  2. Shyam’s Travel World relies on and processes all travel formalities based on the information provided by the Guest. If a guest finds incorrect information on the reservation form, they must notify their travel advisor and have the information corrected immediately within 24 hours of making the reservation.
  3. Inaccurate information may result in tour changes or cancellations. Any losses due to changes or cancellations will  be borne by the guest. Shyam's Travel World is not responsible for this. If your contact information changes, please update it immediately  through  Travel Advisor to avoid missing  any important information.

 

26.3 For any tour, guests need to submit their valid documents for processing the booking and collect the necessary documents from Shyam’s Travel World before the tour, in both these cases guest should observe the timelines to avoid any future issues in the booking/joining the tour. Timelines are shared periodically on guest’s registered contact details.

26.4 While on tour guest/s should carry original documents like Aadhar card, PAN card, passport with valid visa/s, air ticket, insurance copy, NOC if needed in case of minors/children, vaccination certificate, health report (if mandatory) or any other personal/ legal document required at the immigration. Guests are also advised to keep photocopies of the important documents with them and also at their homes in case of emergency.

26.5 Guests should select a group tour or a customized holiday, according to their likes and interests to make the most of their vacation. For a group tour the itinerary/ accommodation/ services etc. are pre-set, however while booking individual customized holiday, guest should ensure that they have selected the services to suit their expectations and confirm the booking. Customized Holidays do not have Tour Manager services available at destination, however all arrangements will be taken care of as per the itinerary through the local associates and Shyam’s Travel World will virtually assist the guest/s for a smooth holiday. Guests are required to be in touch with Shyam’s Travel World’s guest relation representative. If guests wish to have tour manager services on their Customized Holiday (FIT) package, they can do so at an additional cost, subject to availability of a Tour Manager.

26.6 When guests book the ‘group tour’ they are expected to conduct themselves in a manner that is appropriate for group travel. Any abusive/ aggressive/ harmful behaviour towards co-travellers/ Travel Advisor/ Tour Manager/ representative of the associates will compel us to cancel the booking or discontinue the guest from the tour. Company reserves the right to cancel or terminate such guest from the tour and will not be liable for any refund, compensation or consequences.

26.7 In accordance with immigration, customs, government, and community laws, guests are prohibited from possessing or carrying any illegal or restricted items, such as narcotics, weapons, ammunition, explosives, etc. Any violation of this policy will result in the termination of the tour and may lead to legal action in accordance with the applicable laws.

26.8 Guests are expected to follow the instructions of the Tour Manager and maintain punctuality. Any missed sightseeing or services due to delays caused by the guest will be the sole responsibility of the guest, and any expenses or losses incurred as a result will have to be borne by the guest.

26.9 It is the responsibility of all guests to take care of both private and public property while on the tour. Any expenses or penalties resulting from damage caused by the guest(s) to hotel property, aircraft, train, cruise, coach, sightseeing attractions, etc., whether intentional or unintentional, must be settled immediately by the guest(s).

26.10 If any inconvenience is experienced by the guest(s) during the tour, it should be promptly reported to the Tour Manager so that appropriate solutions can be sought from the relevant authorities, whenever possible.

26.11 Guests should be aware that participating in tours operated by Shyam's Travel World may involve certain risks and dangers beyond our control. These risks include, but are not limited to, traveling in undeveloped areas with narrow roads, high altitudes, travel by boat/train/automobile/aircraft, natural disasters, political unrest, acts of terrorism, animal interactions, local customs and practices, varying levels of sanitation, differing safety standards, risks associated with water, air, fire, food, plants, insects, and animal regulations, accidents or illnesses in areas with limited medical facilities, and acts of governments or others against governments. These risks are not exhaustive but serve as examples of the various types of risks involved. By voluntarily participating in these activities, you acknowledge and accept the significant dangers involved and agree to assume all risks.

26.12 If a guest(s) chooses not to or is not allowed to visit a country or part of a country as intended due to any law, condition, or requirement imposed by a governmental authority, the guest(s) will be solely responsible for any missed visits, losses, damages, costs incurred, etc. Shyam's Travel World will not be liable for any refunds, compensation, or consequences in such cases.

26.13 As a lawful consideration for participating in the tour organized by Shyam's Travel World, you agree not to make any claims or file any lawsuits against Shyam's Travel World, its group companies, or its personnel for bodily injury, emotional trauma, death, property loss or damage, etc., regardless of the cause.

26.14 We strongly recommend that every guest obtain travel insurance before joining the tour. In the event of an accident or incident leading to an insurance claim, the guest must directly communicate with the insurance company and provide the necessary documents requested for claim settlement. The decision to grant or reject the claim rests solely with the insurance company, and Shyam's Travel World will not be held responsible for the outcome. Any disputes regarding the adequacy of the settlement amount or the rejection of a claim should be addressed directly with the insurance company by the guest(s).

26.15 Airlines, cruises, and trains have implemented stricter baggage policies with restrictions on size and weight. Therefore, guests are advised to travel light with small bags that they can easily carry on their own. If the guest(s) avail themselves of porter services at train stations, airports, cruise terminals, immigration points, hotels, or any other place, they shall directly pay the porter charge or tip.

26.16 Tipping is customary in all parts of the world for services rendered, such as porters, coach drivers, guides, etc., unless otherwise stated in the tour itinerary inclusions.

26.17 Friends, relatives, or colleagues visiting guests on the tour are not permitted to utilize any services unless they have obtained prior permission and paid for them in advance. Such admission or permission will be subject to availability.

26.18 This agreement, although entered on your behalf, also binds your heirs, assigns, and legal representatives.

26.19 Shyam’s Travel World generally includes all services and maximum sightseeing as per the tour itinerary. However, guests should carry money for personal expenses, shopping, optional sightseeing, local delicacies, beverages, additional facilities offered by the hotel/resorts, and also for any emergencies due to medical reasons or unforeseen/force majeure situations.

27. Liabilities and Responsibilities of Shyam’s Travel World

 

27.1 Shyam’s Travel World acts as a facilitator that collaborates with various independent service providers for tour-related services, including airlines, cruises, railways, transporters, sightseeing companies, hotels, restaurants, caterers, and snack suppliers. While we take every precaution to ensure the smooth operation of the tour, we have no control over the operations and running of these service providers. Therefore, in the event of any issues faced by guests while availing the services (which are the sole responsibility of the service provider), Shyam’s Travel World shall not be held responsible or liable for any compensation for operational inefficiencies, misrepresentations, acts, omissions, errors, warranties, breaches, or negligence on the part of any service provider.

 

27.2 Shyam’s Travel World is not liable for the provision of medical care or the adequacy of any care rendered in the event of a medical emergency or accident. We are not responsible for any risks and dangers that may arise beyond our control.

 

27.3 Any gestures of courtesy extended by Shyam’s Travel World to minimize the impact, loss, or damage in the event of force majeure or unforeseen situations shall not be considered an admission of liability or a waiver.

 

27.4 In a fast-paced world, human errors and omissions are expected. Shyam’s Travel World reserves the right to correct any mistakes in tour prices and re-invoice the guest, even if the booking has been made and confirmed. However, if the guest disagrees and wishes to withdraw the booking, they must notify us within 48 hours of being notified of the error. In such cases, the booking will be canceled, and any advance payment made by the guest will be refunded within 30 working days.

 

27.5 Occasionally, the presence of a celebrity, dignitary, or Shyam’s Travel World founder may be advertised as part of the tour itinerary. However, due to unavoidable circumstances, these individuals may not be able to join the tour. Shyam’s Travel World will not be held responsible for such situations.

 

27.6 In the event of a guest’s withdrawal from the tour for any reason, our Cancellation Policy will apply. Shyam’s Travel World is not liable for any losses incurred by guests in their personal capacity and therefore has no liability relating to any loss of job, business, occupation, contract, interruption, loss of business opportunity, etc.

31.2 In addition, guest's personal information may be disclosed as required by law or by order of the court or any government or statutory authority.

31.3 We may send transactional and promotional messages to guests via SMS, email, Whatsapp or phone calls to provide updates on tour status, new launches, promotions, festive offers, and greetings. By booking a tour/package, guests consent to the use and sharing of their personal data as described above.

31.4 We reserve the right to use guest testimonials, emails, on-tour photos, video clips, and social media posts tagged to our company for the promotion of tours, packages, destinations, and information videos on any media without obtaining further consent or payment.

31.5 We may refer guests, upon request, to prospective guests for the promotion of our company's business.

Failure to follow this procedure may affect the manner in which your complaint is dealt with. Any unresolved issues must be brought to our notice within 30 days after the completion of the tour/service. Claims made after this period will not be considered.

32.7 Applicable Law and Dispute Resolution: We are committed to participating in a consumer-friendly dispute resolution process. Both parties agree to notify each other in writing and attempt to negotiate an informal resolution at least 30 days before filing a complaint. If the dispute cannot be resolved within 60 days, either party may commence legal proceedings. Any legal notices must be sent to our office address.

32.8 Arbitration: Any dispute arising from these Conditions or any agreement between guests and our company shall be referred to an Arbitral Tribunal consisting of a sole Arbitrator appointed by mutual consent. The arbitration proceedings shall be conducted in English, and the venue shall be Mumbai. The expenses involved in the arbitration proceeding shall be shared equally by both parties.

32.9 Indemnification: Guests shall indemnify our company against any legal proceedings initiated against us due to their actions. Guests also agree to indemnify us against third-party claims, actions, damages, and remedies arising from their participation in the tour.
